Terms of Service
The rules for using Quark. Please read them — using Quark means you agree to them.
Quark is in early access. As with any AI design tool, always review and validate designs before manufacturing or relying on them.
Quark is operated by Mariana Silva (“Quark,” “we,” “us,” or “our”). These Terms of Service (the “Terms”) are an agreement between you and us and govern your access to and use of the Quark website, applications, and services (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who can use Quark
You must be at least 16 years old to use the Service. By using the Service you represent that you meet this requirement and that any information you give us is accurate. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.
2. Your account
You are responsible for everything that happens under your account, so keep your sign-in secure and tell us promptly if you think it has been compromised. We may suspend or terminate accounts that violate these Terms.
3. The Service
Quark lets you design 3D models by chatting with an AI agent that writes and edits CAD model, renders geometry, and helps you refine a model toward what you asked for. You can export models in standard formats such as STEP and STL.
The Service is offered on an early-access basis. Features may change, break, or be removed, and we may impose or adjust limits at any time. We do not promise that the Service will be uninterrupted, error-free, or that any model, render, measurement, or export will be correct.
4. Plans, usage, and billing
The Service has usage tiers, each with an allowance for AI agent usage. When your allowance for a billing cycle runs out, agent features may pause until the cycle resets or you upgrade.
We show prices, allowances, and terms before you are charged. Fees are non-refundable except where the law requires otherwise, and we may change pricing and allowances on a forward-looking basis.
5. Acceptable use
You agree not to use the Service to:
- break the law or infringe or violate anyone else’s rights, including intellectual property and privacy;
- design or make dangerous or prohibited objects — such as weapons or anything intended to cause harm — or anything you are not permitted to make;
- abuse, disrupt, overload, or interfere with the Service or its infrastructure, or bypass its limits, authentication, or security;
- misuse the Service — for example, reverse engineering or reselling it, or submitting content you have no right to submit.
You are responsible for the prompts you submit and the models you create, and for confirming that anything you make or manufacture is safe and lawful.
6. Your content
“Your Content” means the prompts, images, files, and other inputs you submit, together with the model source and designs the Service produces for you from those inputs. As between you and Quark, you own Your Content. We do not claim ownership of it.
You grant us a worldwide, non-exclusive license to host, store, process, transmit, and display Your Content as needed to operate, secure, and improve the Service and provide it to you — including sharing it with the providers described in our Privacy Policy. Keep your own copies of anything important: we store your model source but do not guarantee backup or recovery.
7. AI output
The Service uses AI models to generate CAD geometries (“Output”). Subject to these Terms, you may use Output you generate for any lawful purpose. Because of how generative AI works:
- Output may be inaccurate, incomplete, or unsuitable for your purpose, and different users may receive similar Output for similar prompts;
- we make no representation that Output is original or free of third-party rights, and you are responsible for reviewing it before use;
- Output is not engineering advice and is not verified for real-world use. You must independently verify dimensions, tolerances, materials, and safety before manufacturing, printing, or relying on any model.
8. Our intellectual property
We own the Service — including the software, its user interfaces, the agent’s system prompts, and Quark branding — and grant you a limited, non-exclusive, non-transferable, revocable right to use it as intended. All rights not expressly granted are reserved. This does not affect your ownership of Your Content (Section 6).
9. Disclaimers
The Service and all Output are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be secure, uninterrupted, or error-free, or that Output will be accurate or fit for your purpose. You use the Service and any Output at your own risk.
10. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, or for the cost of any physical goods you manufacture based on Output, arising out of or relating to the Service.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law — including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if we reasonably believe your use creates risk or legal exposure, or if we discontinue the Service.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, take reasonable steps to notify you. Your continued use of the Service after changes take effect means you accept the revised Terms.
13. Governing law
These Terms are governed by the laws of England and Wales, and you agree to the exclusive jurisdiction of the courts of England and Wales, except where applicable law lets you bring proceedings elsewhere.
